this file is license.txt ----- quick summary: - This is copyrighted free software: do whatever you want with it as long as you're not making a profit off of it. - I am not responsible if anything goes wrong. - if you want to redistribute the program, please distribute only the installer. ----- This software is copyright 2002-2004 by Samson Chee. The contents of this (and only this) archive is freeware. It is free, as in cost, but not yet free, as in opensource. Licensing terms may, and probably will, change for future releases. You may do whatever you want with this archive, except that: - you may not claim it as your own. - this license file shall remain part of any redistribution. - for personal use, I would prefer that you do not redistribute individual files but only the installer. - (for commercial use,) you may not distribute this archive as part of a larger collection (of software) without contacting me first. This means, among other things, that without contacting me first, this archive may not be put on a compilation CD with a cost above the cost of the media and delivery, nor may this archive be bundled with another product. - Note that the intent of this restriction is not to, for example, prevent the inclusion of this archive on a compilation CD of other freely obtainable software (including shareware). This means, among other things, that this archive may be included in a compilation similar to the simtel CDs. - An example situation that I consider commercial use is to include this archive on a CD or packaged product, with another product that is not freely obtainable. I.e. I do not want my work to benefit your product without my permission. - you may distribute the installer over the internet, but only if it is available for free download, and not associated with another product. If this archive will be associated with another product, you must contact me first. - Again, note that this does not, for example, preclude the inclusion of this archive on software repository websites even if they contain products that are not freely obtainable as long as this archive is not construed as being part of, or closely associated with, a product that is not freely obtainable. I claim copyright on the software, but acknowledge that the main background images were taken from earthobservatory.nasa.gov. There has been some image manipulation done on some of the images. Prior to version 0.8, the control panel component used the ColorStaticST subclass (c) 1998 by SoftechSoftware. For code maintenance reasons, as of version 0.8, the ColorStaticST subclass has been removed. (While we're on acknowledgements, the installer (InnoSetup), while technically not part of this program, is copyright 1997-2002 Jordan Russell.) If you choose to use this software, I do not guarantee, nor make any claim, that it will work for you. However, it does work for me to the best of my knowledge, but I am aware of platforms on which it does not work. You may try it on your own system, but you should be aware that part of the program, by design, will try to hook onto the windows desktop. Because of that aspect of it's function, there is a possibility that it may destabilize windows, although my experience is that windows xp and windows 2000 is more immune to the effects of an unstable desktop. Again, this software should work on your system, but, as is standard practice, I do not make any guarantee or claim that it will. I will not take any responsibility for any damage that this software may cause, but I would appreciate it if you let me know of such, so that I can improve this software. My intent in terms of licensing should be clear. If you don't like the lack of fancy legal language, please end the installation process now and remove this archive from your system. If I think that you are using this software against the intent of my terms of license, I may contact you to clarify the situation, and at my option, to request that you stop using and/or distributing the software. Again, if you don't like these terms, please remove this archive from your system. More information about this project may be found at: http://www.herethere.net/dt
